By using this website or placing an order through this website, you agree to the Terms and Conditions and our Privacy Statement, if you do not agree, you should not place an order.

2. USE OF OUR WEBSITE 

These Terms and Conditions are the only terms and conditions applicable to the use of this website and supersede all other terms and conditions. You declare that, by placing your order, you have read and accept these Terms and Conditions without reservation.

By using this website you agree that: 

1. You may only make use of the website to make legally valid enquiries or orders. 

2. You may not place any speculative, false or fraudulent orders. 

3. You also agree to provide us with your email address, postal address and/or other contact details and you agree that we may use this information to contact you if necessary. For our part, and in accordance with current law, we will never disclose your personal data to third parties, you will only receive our Newsletter, where you can always unsubscribe easily by requesting it through the contact form. If you are not subscribed to the Newsletter, the information you provide in your order will only be used for the purpose of managing your order. 

4. If you do not provide us with all the information we need, we will not be able to process your order. 

5. By placing an order through this website, you guarantee that you are over 18 years of age and that you have legal capacity.

3. AVAILABILITY OF THE SERVICE 

The items offered through this website are available in Spain and in the countries that appear in the shipping list. For other countries please contact us via the contact form.

We do not ship to P.O. Boxes, therefore it is necessary that you provide us with the exact delivery address. To avoid problems in the event that you are not at home at the time of delivery, please do not forget to provide a contact telephone number.

4. HOW THE SALE IS FORMALISED 

No contract of sale will exist in relation to any product until your order has been expressly accepted by us. If your order is not accepted, the amount of your order will be refunded in full.

Once you have placed an order, you will receive an email confirming that we have received your order. Please note that this does not mean that your order has been accepted. All orders are subject to acceptance by us. Your order will only be accepted when we send you a shipping confirmation and this will relate exclusively and only to those products indicated on the shipping confirmation. We are not obliged to supply you with any other products.

5. PRODUCT AVAILABILITY 

All orders are subject to availability. If supply or stock difficulties occur, we may offer you substitute products of the same or a different price, but if you do not wish to exchange, we will refund any amount you may have paid.

We reserve the right to withdraw any product from this website at any time.

We accept no responsibility for the removal or modification of any product or content on the website

6. DELIVERY 

Deliveries are managed by the company ENVIALIA. Delivery times vary depending on the destination of the shipment. Standard deliveries to Spain and Portugal take 48 working hours approx. For deliveries to the European Community between 5 and 7 working days. 

If you wish to receive your order by express service, please contact us through the contact form.

The shipping costs vary depending on the place of delivery, for the different areas and are automatically calculated according to the volume and weight. You can see the shipping costs once you have chosen your products by clicking on the shopping cart and choosing the delivery zone.

Remember that we do not ship to P.O. Boxes, so it is necessary that you give us the exact delivery address.

To avoid problems in the event that you are not at home at the time of delivery, we would appreciate it if you could provide us with a contact telephone number where you can be reached.

7. PRICE AND PAYMENT 

The price of the products will be the price stipulated at all times on our website, except in the case of obvious error. Whilst we try to ensure that all prices shown on the site are correct, errors may occur. If we discover an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, the order will be considered cancelled and any monies paid will be refunded in full.

The prices on the website include the corresponding taxes, but exclude shipping costs.

Prices may change at any time, but will not affect orders for which we have already sent a shipping confirmation.

By making a card payment you confirm that you own the card.

Payment" cards will be subject to checks and authorisations by the card issuer, but if the card issuer does not authorise payment, we will not be liable for any delay or non-delivery and will not be able to complete the sale.

8. EXCHANGES AND REFUNDS

8.1 EXCHANGES:

You have two options to change your online purchase (size, colour or model):

1. In our physical shops by presenting the purchase receipt or printing the invoice from the section "my orders" on our website.

2. From your home, requesting a return by email: pedidos@brightyandco.com and making a new online purchase.

In both cases you have a period of 15 days from receipt and to proceed with the exchange you must check that your order meets the following conditions: 

- The product must not be used. 

- It must be sent in the same conditions in which it was received. 

To request an exchange, you must contact us by email: pedidos@brightyandco.com indicating the reference of your order and your name, as well as the reasons why you are requesting the exchange.

- You must send the item using or including its original packaging as well as the instructions, documentation and packaging that may accompany it. 

We will not exchange or return products that are not in the same condition in which they were received, or that have been used beyond the mere opening of the product.

It is only possible to process exchanges of products purchased in our online shop.

8.2 RETURNS:

You have two options to return your online purchase (size, colour or model):

1. In our physical shops by presenting the packing slip that comes in the box. In this case a voucher will be issued for the corresponding amount.

2. From your home by requesting a return by e-mail: pedidos@brightyandco.com. In this case the customer will have to pay the shipping costs, which will be deducted from the amount of your refund.

In both cases you have a period of 15 days from receipt and to proceed with the exchange you must check that your order meets the following conditions: 

- The product must not be used. 

- It must be sent in the same conditions in which it was received. 

Once received, we will proceed to examine it and will inform you by e-mail within a reasonable period of time if the return or replacement of the product is appropriate. Once the return has been approved, you will receive the amount in the same way in which you made the purchase. Remember that the credit card payment always depends on your bank.

Products that are not in the same condition in which you received them, or that have been used beyond the mere opening of the product, will not be returned.

It is only possible to process returns of products purchased in our online shop.

*For hygiene reasons, we do not accept exchanges or returns of costume jewellery, bikinis or swimming costumes.

9. DISCLAIMER OF LIABILITY 

Our liability in relation to any product purchased on our website shall be strictly limited to the purchase price of such product.

Due to the open nature of this website and the possibility of errors in the storage and transmission of digital information, we do not warrant the accuracy and security of information transmitted or obtained through this website unless otherwise expressly stated on this website.

10. INTELLECTUAL PROPERTY 

You acknowledge and agree that all copyright, trademark and other intellectual property rights in any material or content provided as part of the website shall at all times remain at all times vested in us.

11. WRITTEN COMMUNICATIONS 

By using this website, you agree that most communications with us will be electronic. Notifications you send to us should preferably be sent via our contact form.

Notifications will be deemed to have been received 24 hours after an e-mail has been sent. If you believe you have not received them, please contact us via the contact form.

12. DIVISIBILITY 

If any of these terms and conditions or any provision is held to be invalid, illegal or unenforceable to any extent by any competent authority, it shall be severed from the remaining terms, conditions and provisions which shall continue to be valid to the extent permitted by law.

13. OUR RIGHT TO CHANGE THESE TERMS AND CONDITIONS 

We have the right to revise and amend these Terms at any time. 

You will be bound by the policies and Terms in effect at the time you place each order, unless we are required by law or governmental action to make changes to such policies, Terms or Privacy Statement, in which case any such changes will also affect any orders you have previously placed.

14. GOVERNING LAW AND JURISDICTION 

Sales of products through our website shall be governed by Spanish law.

As a consumer, nothing in this clause shall affect your rights as a consumer under current legislation.
